Information and documents to file a plant variety patent (plant breeder right) application in Italy


The exact name and address of the Applicant(s);

the variety's denomination;
the breeder's name (a person, not an entity);
how the variety was obtained, namely the parental cell lines' denominations, the method utilized, etc.;
how the variety is maintained as pure;
main differences between the variety and a similar variety (denomination to be indicated);
whether the variety is registered in National Registers, including the EU Catalogue, with reference;
copy of relevant UPOV Questionnaire, duly filled-in;
three copies of photographic representations (21x30 cm) of the variety, signed by the applicant on the back side;
a Power of Attorney, signed by the Applicant(s);
a declaration filed and signed by the Applicant(s);
a certified copy of priority documents, if Priority Rights are claimed;

IMPORTANT: it is to be noted that the Italian Ministry of Agriculture does not accept trial results obtained in other UPOV States, unless a priority right is claimed. Therefore, in order to avoid trials in Italy and payment of relevant fees, the Applicant(s) may:

claim a priority right and file the granted Plant Breeder Right Certificate within four years from the priority date
or
file also an application for the Registration in the National Register for the same variety: trial results will be utilized also for the Plant Breeder Right examination.
