Domestic Patents are filed in Italy under the provisions of Legislative
Decree 30/2005, successively revised in various times in order
to be integrated with all subsequent developments. Patentability
criteria are set forth in Art. 45, according to which eligible
to form subject matter of a patent are novel inventions which
involve an inventive activity and which are capable of having
an industrial application.
Not deemed to be inventions within this meaning are in particular
the following:
a) discoveries, scientific theories and mathematical methods;
b) schemes, rules and methods for performing mental acts, playing
games or doing business and programs for computers;
c) presentation of information,
to the extent to which the invention concerns discoveries, theories,
schemes, rules, methods and programs as such.
Not deemed to be inventions are methods for surgical or therapeutic
treatment of human or animal body and diagnostic methods applied
to human or animal body. This provision is not applicable to products,
substances or mixtures of substances for use in any of said methods.
