A Power of Attorney (one for each application,
unless a General Power of Attorney is granted).
List of goods and/or services to be covered by the mark, unless
the Applicant wishes the mark to be filed for one or more headings
of the International Classification.
If the Trademark has a particular graphics, it is necessary a
sample of the same Trademark.
If priority rights are to be claimed (Convention cases), a certified
copy of the basic priority application(s) must be filed within
six months from the Italian filing date, together with a translation
into Italian. In such cases, if the basic application was filed
in (an)other name(s) than the Italian application, an assignment
of priority rights is required, which must be effective as of
a date earlier than the filing date of the Italian application.
The assignment shall be executed as described in the chapter "Assignment,
License ..." in our website.
Intent to use is presumed by Law and is sufficient for filing
applications and for obtaining registrations/renewals.
A trade/service mark is to be used within 5 years from the date
of grant of the Registration and thereafter its use should not
be discontinued for any period longer than 5 consecutive years,
unless there are evident and grounded reasons to excuse it; otherwise
a third party could sue the Registrant at Court for a declaratory
judgement of lapse for non-use.
Duration of a Registration is 10 years from the filing date and
renewal may be applied for in the last year of validity thereof
or belatedly within 6 months after the expiration of the 10th
year, with fine. No statement or proof of use is requested for
filing or obtaining a renewal application/registration.
One application may cover goods/services in an unlimited number
of classes and it is immediately legally effective as soon as
it is filed.
