Based upon an Italian registration, it is possible to obtain
an International Registration according to the Madrid Agreement,
if the applicant owns a serious commercial establishment in Italy.
The former Trademark Agreement between Italy and France of January
8th 1955, whereby nationals resident or doing business in either
country could simply extend their national registrations to the
other country, has been dissolved since September 1st 1983.
The Agreement of Amity and Good Neighborhood signed between the
Republic of Italy and the Republic of San Marino is still in force
and provides for the mutual protection of the trademarks of the
two countries and for the acknowledgment of their use. However,
the Republic of San Marino has enacted its own law now, and therefore
it is advisable filing a separate application in San Marino.
The Lateran Pacts provide for a reciprocal trademark protection
with Vatican City, even if under the provisions of the former
Italian Trademark Law of 1929.
