International Trademark and Design - New Accession to Madrid and
Aja Systems
The system of international registration of marks is governed
by two treaties: the Madrid Agreement concerning the International
Registration of Marks, and the Protocol Relating to the Madrid
Agreement, which was adopted in 1989.
Recently other two Governments – Botswana and Vietnam have
joint the Protocol: the new accessions bring the number of Contracting
Parties of the Protocol to 69, and the total number of
Contracting
Parties of the Madrid System to 79.
Botswana has joint the Hague System for the International Registration
of Industrial Designs too.
The systems of international registration of marks and designs
preview the possibility to apply a subsequent application in order
to extend the protection of the distinctive signs to new Countries,
but there is no administrative way to get protection in case of
a previous legitimate registration by third parties.
For trademarks the term of protection is of ten years with the
possibility of further periods of renewal, whereas for designs
the term of protection is generally five years, with the possibility
of further periods of renewal up to, in most cases, fifteen years:
it depends on local legislation.
