Application for registrations in Cabo Verde
The competent authorities in Cape Verde a former Portuguese
territory in Western Africa, are accepting national filings for
registration of trademarks, patents and designs since last year.
In general terms, the local authorities in Cabo Verde consider
that industrial property matters are governed by the provisions
of the old law of 1959(the former Portuguese Industrial Property
Code) as amended and adapted by the Decree-Law 7/2003.
The applications are filed at the DGIE, Directorate-General of
Industry and Energy (Direcçao Geral da Indùstria
e Energia).
In respect of trademarks the publication of "cautionary notices"
was the only means of protection although with considerable legal
uncertainty as to the possible effects.
According to the new framework and the Registry of Cabo Verde
trademark registrations are multi-class and will have a renewable
duration of 10 years counted from the registration date, priority
claims will be possible and the International Classification system
will be followed.
