FORMAT – Forthcoming the first Deontological Code
Format is not considered as an intellectual work worth
to be protected under copyright laws: as a consequence it has
got a very narrow legal protection.
Neither Italian nor Community laws have so far provided Format
with a complete and adequate regulation.
In the meantime, SIAE [Società Italiana degli Autori ed
Editori - Authors’ & Publishers’ Italian Society]
drafted the first Deontological Format Code with which:
- it has been given a legal definition of Format;
- it has been created a suitable register with which SIAE will
legally certificate the filing: the applicant will have a proof
– with fixed date – of the existence, as well as the
paternity of the Format;
- it has been created a legal system with which is possible to
gazette the filings, the holders of the Format and, eventually,
the sentences judging the validity of each single Format;
- moreover, in case of litigation, it has been established the
right of parties involved to solve the dispute with the mediation
of a SIAE Expert Committee or submitting the matter to a specialized
Tribunal which will pronounce a final, public and enforceable
(for the parties involved) judgement.
The Code has been examining by a SIAE Experts Committee: we are
waiting to know its official opinion on the matter.
