December 17, 2003 – Possible reimbursement of recordal fees.
Recordal fees must be reimbursed by the Italian Patent
and Trademark Office in the event of the applicant withdrawing
the recordal application before the procedure is completed.
The Board of Appeal, upholding our reasoning in its entirety,
excluded the possibility of a fee being due for the mere filing
of a recordal, holding that the tax presupposes the “completion
of the procedural cycle initiated (that is the recordal)”.
