Decree No. 168 of June 27 2003
Specific divisions of Industrial and Intellectual Property
to Tribunals and Courts of Appeal
According to Article 16 of Law No. 273/2002 the Legislative Decree
No. 168 of June 27 2003 has been issued and published on the Official
Gazette of July 11 2003 No. 159 being effective since July 12
2003.
The measure has instituted specific divisions of Industrial and
Intellectual Property to the Tribunals and the Courts of Appeal
of Bari, Bologna, Catania, Firenze, Genova, Milano, Napoli, Palermo,
Roma, Torino, Trieste and Venezia.
The specific divisions are competent on disputes relevant to national,
international and community trademarks, patent inventions and
new vegetal varieties, utility models, designs, models and copyrights
as well as matters of unfair competition which interfere with
the protection of the Industrial and Intellectual Property.
The decree assigns to the treatment of the new specific divisions
the cases which have as subject the above mentioned matters since
July 1, 2003.
The pending disputes on June 30 remain assigned to the competent
Judge according to the previous normative.
